  • Work is slated to begin on this year’s Rehab Asphalt Streets project, beginning with a milling and overlay project to smooth out the road on MacArthur Street between the tunnel and Acme Road.

The project will end with corrective work done to 45th Street between Leo and Kickapoo Streets.

Work on MacArthur Street will begin in first week of August and will be completed by Haskell Lemon Construction.

Other streets planned for milling and overlay this year include Independence Street from Kickapoo Street to Airport Drive, and another section of Independence from Kickapoo to Union Street, City Engineer John Krywicki said.

These sections of Independence will not be completed until the intersection of Kickapoo and Independence Streets is completed, which is being completed as a part of the Kickapoo Widening Project, Krywicki said.

The Kickapoo Widening Project is also contracted to Haskell Lemon Construction.

At the end of the project, corrective work will be completed on 45th Street between Kickapoo and Leo Streets.

Originally 45th Street was to be completed as a part of last year’s Rehab Asphalt Streets project, however the contractor, Nash Construction, did not meet the city’s requirements for smoothness and “rideability” on the road.

An independent lab was brought in, and confirmed the road was not in compliance. The contractor completed corrective work, however a second lab test showed many of the same rough patches in the same areas, according to previous reports.

At that time the city entered into negotiations with Nash Construction, after asking them to cease work and not begin the other street resurfacings included in the contract.

The other two streets were Independence Street from Kickapoo to Airport Drive, MacArthur Street from Acme to Leo Streets, and Independence from Park to Broadway Streets.

Only the section of 45th Street, and Independence from Kickapoo Street to Airport Drive are being included in this year’s resurfacing project. The other two streets are not listed to be resurfaced at this time.

City Attorney Mary Ann Karns confirmed May 29, 2013 – more than seven months after the city asked Nash Construction to cease work – that negotiations were ongoing.

This week, however, Karns declined to comment on the negotiations.

Additionally, she declined to confirm whether or not negotiations were continuing, or whether or not a settlement had been reached.
