  • A Pottawatomie County judge ruled Monday there is sufficient evidence for a Shawnee man to face trial in his wife's shooting death.
    Justin Dewayne Byus, 25, appeared in court for his preliminary hearing, where he was bound over on a first-degree murder charge. He is now scheduled to enter a plea during an arraignment scheduled 9 a.m. Aug. 28.
    Byus is formally charged in the death of Cathy Byus, 35, and is accused of causing her death by shooting her with a .40-caliber pistol, documents show.
    While awaiting his next court date, Justin Byus remains jailed without bond in the Pottawatomie County Public Safety Center.
    Cathy Byus, 35, was found dead in her Granada Estates home at 27 Bella Vista in Shawnee.
    The official cause of her death was ruled by the medical examiner as multiple gunshot wounds, with manner of death confirmed as homicide.
    The arrest warrant in this case shows a friend of the defendant called police after the suspect called to confide in him that he had allegedly shot and killed Cathy Byus sometime during the overnight hours March 21.
    The warrant shows the friend, who reported the couple fought nearly every night, had gone with Justin Byus to a strip club in Oklahoma City earlier that night, where the suspect drank a "bucket of beer," the arrest warrant reads.
    Justin Byus returned home about 3 a.m. according to the warrant, and allegedly called his friend a couple times after that. One of those allegedly involved his wife's cell phone and him discovering she was allegedly texting another guy, with him saying he found a sexually explicit picture of that man on her cell phone, the affidavit shows.
    According to the warrant, Byus later made another call and told his friend he had shot his wife, documents show, and Shawnee police converged on the typically quiet neighborhood.
    As Shawnee police searched the home, they found the body of Cathy Byus in the bed of the master bedroom, with the warrant indicating that a blanket covered the victim, who had her cell phone in her left hand.
    Police also found the couple's son, James, a toddler, unharmed in another bedroom. Reports indicate he has since been in the care of relatives.
    Cathy Byus grew up in Bethel Acres and graduated from Bethel High School in 1995. Her graveside funeral services were held in Southwest City, Mo., where her parents also are interred.
    Her parents, Gary and Linda Haas of Tecumseh, were murdered in 2010 while vacationing in New Mexico after three inmates escaped from an Arizona prison. Their deaths occurred months after Cathy and Justin Byus married in May 2010.
    If convicted of first-degree murder, Justin Byus could face the death penalty, imprisonment for life, or life without parole.
