  • COLUMBIA, S.C. (AP) — The South Carolina couple seeking to adopt a girl of Cherokee heritage says an attempt to delay that process should be scuttled.

Attorneys for Matt and Melanie Capobianco say in papers filed Wednesday that a request from the girl's biological father should be denied. The father, Dusten Brown, says South Carolina justices misread the U.S. Supreme Court's June ruling empowering a state court to finalize the girl's placement.

Later Wednesday, a South Carolina family court holds a hearing over the adoption of now-3-year-old Veronica.

The Capobiancos raised Veronica for two years and have sought to adopt her since birth.

State courts sent Veronica to live with Brown in Oklahoma in 2011. But earlier this year, South Carolina justices ordered a family court to finalize the Capobiancos' adoption.
