76-year-old man convicted, released in shooting

A 76-year-old Asher man who stood trial on a charge of assault and battery with a deadly weapon was found guilty by a Pottawatomie County jury Tuesday, but was released from custody after the jury sentenced him to time already served — 89 days in jail.
Charles Wayne Kettler Sr. was accused of assaulting Gordon Lewis with a .22 caliber rifle on Feb. 12, court charges show.
According to a court affidavit, Kettler was accused of shooting Lewis in the arm during an argument, although he claimed it was self defense. When investigating the incident, Sheriff’s deputies observed Lewis had suffered an entrance and exit wound and Kettler was arrested and jailed in the case.
His trial began before District Judge Douglas Combs Monday in Pottawatomie County District Court. First Assistant District Attorney Russ Cochran prosecuted the case, while Karen Byars served as Kettler’s defense attorney.
After deliberating about two hours Tuesday afternoon, the jury returned a verdict of guilty. The jury fixed Kettler’s punishment to be the same amount of time he’s already served, which has been 89 days in jail, court records show.
Kettler was ordered to pay his court costs.
