A Shawnee man faces a felony sexual battery charge on allegations of inappropriate touching of a customer while giving her a massage at a local nail salon, court records show.

Hao Van Pham, 49, was identified as the suspect after the investigation, according to the arrest affidavit, and was formally charged Tuesday in Pottawatomie County District Court.

According to the probable cause arrest warrant, a search warrant was served earlier this month at Lifestyle Nail and Day Spa at 45th and Kickapoo as part of an investigation after a woman spoke with police about a massage she experienced there.

The affidavit indicates the woman, who goes there often to get her nails done, overheard a husband and wife talking about a massage the wife had received.

Unaware they gave massages, the woman asked about them and was told she didn't need an appointment and they could fit her for a massage if she had a few minutes to wait.

The massage, with the woman wearing just panties and having a sheet, started with her shoulders, back and arms and seemed normal with the hot rocks, but according to the affidavit, the massage continued with touching of her buttocks under the sheet.

The man allegedly asked the woman her name, age and told her how pretty she was, then did a normal neck massage before moving lower, the affidavit shows.

The massage allegedly included her panties being rolled down to include touching of her private areas under her panties, the affidavit alleges, with the sheet also being pulled down to expose her breast and the suspect allegedly massaging and grabbing her breasts.

The woman told police she was uncomfortable but was afraid to say anything while there. She told police the man referred to himself as “Henry” and said he had worked there for three years, according the affidavit, although the woman told officers she had never seen him there before.

As a result of the search warrant, police identified a suspect as Hao Van Pham, also known as “Henry,” according to the court document, with police seizing several items of potential evidence. The woman also later identified him from a photo lineup, the court documents show.

Charges were filed Tuesday and his case is now progressing through the court system. His next court date isn't listed with the charges.
