Extradition papers delivered to Governor for warrant in 'Uncle G' case

District Attorney Richard Smothermon on Thursday delivered to Gov. Mary Fallin’s office the formal extradition papers seeking a warrant to bring a Pennsylvania man to Oklahoma to face charges.

Smothermon has been working to extradite Gary J. Doby, 65, also known as “Uncle G,” in connection with the pornography case of a former McLoud teacher.

Doby, jailed in Pennsylvania, faces nine felony counts in Pottawatomie County District Court, while the former teacher, Kimberly Crain, 48, faces 23 counts.

“I delivered the extradition requests to the Governor today” Smothermon said Thursday afternoon, adding the request included several thick stacks of required paperwork.

To ensure there are no glitches in the process, Smothermon said he consulted with the Attorney General’s office in the matter, and also contacted the Governor’s office in Pennsylvania.

“Both governors have shown great willingness to expedite,” the process, he said, adding he believes the warrant could be issued as early as next week.

Doby has been jailed in Pennsylvania on a $1 million bond since his arrest Dec. 15. He didn’t waive extradition to Oklahoma during previous hearings, so the weeks-long process to obtain a Governor’s warrant began.

While the extradition process continues for Doby, Crain remains jailed on $1 million bond, although she is expected to be in court Monday for a bond reduction request. Her preliminary hearing is scheduled in March and the next court date for Doby won’t likely be scheduled until he is in Oklahoma.

Doby, a former Oklahoma Baptist University professor and retired professor of early childhood, was arrested at his home in Bloomsburg, Pa. after being identified as “Uncle G” in the investigation involving Crain. Charges allege Crain took photographs of as many as 14 young students while they were changing in her classroom or at her home. Prosecutors allege those images were sent to Doby and Crain also is accused of setting up Skype video chats on her school computer between her students and Doby.

Of the felony counts, Crain is charged with all 23, while the first nine counts apply to Doby. Counts one through eight are manufacturing of child pornography, and count nine involves conspiracy to manufacture juvenile pornography.

Crain is also charged in counts 10 through 23, which include 10 counts of lewd molestation, two counts of possession of juvenile pornography and a charge of aggravated possession of juvenile pornography for having more than 100 images on her laptop computer.

For the lewd molestation counts, Crain is accused of forcing the children to undress and expose themselves, in some cases behind a sheet that was set up in her classroom, while the children were secretly being photographed. In other cases she is accused of photographing children wearing bras and panties in her home and having them pose and dance.

Crain resigned from her teaching job Nov. 28 amid the ongoing investigation by McLoud and Shawnee police, along with the FBI. That probe began in mid-November after several of Crain’s female students attended a Christmas tree decorating and pizza party at her Shawnee home and allegations surfaced.

Court records show Crain met Doby when he was a professor at OBU from 1985 to 1987, and during that time, Crain was a student studying toward her education degree.
