A McLoud man charged with first-degree murder in the October 2010 child abuse death of his girlfriend’s child was set for jury term this week but waived his right to a speedy trial Monday in Pottawatomie County District Court.
Jason William Cline, 27, was set for jury trial this week, but his case is now scheduled for the May 14 jury trial docket.
Charges in this case allege Cline caused the death of Cody Paul Chama, 3, by “the willful or malicious use of unreasonable force” to the child’s head on Oct. 5, 2010, causing wounds from which he died.
Cody died Oct. 6, 2010, at Children’s Hospital at OU Medical Center. According to the arrest affidavit originally filed in this case, Cline was reported to be the boyfriend of Cody’s mother, Amanda Cheek, and they lived at a home in McLoud. The affidavit also shows Cline “was the only adult with Cody Chama when he sustained injuries that led to his death.”
Cody was taken to Unity Health Center, then transferred to Children’s Hospital in Oklahoma City, where doctors said tests showed a brain bleed and severe hemorrhaging in both eyes, with a doctor concluding they were injuries consistent with child abuse, court records showed.
McLoud police began investigating the case, and the District Attorney’s Drug and Violent Crime Task Force investigators also probed the case, resulting in Cline’s arrest.
If convicted of first-degree murder, child abuse, Cline could face the death penalty, imprisonment for life, or imprisonment for life without parole.
